The US Patent and Trademark Office (USPTO) is exploring the integration of artificial intelligence to enhance patent approval efficiency. Vendors, however, are expected to accept exposure over financial rewards. A recent request for information outlines the USPTO’s plan to collaborate with AI providers to address patent and trademark processing delays by leveraging technology to scan domestic and international patents as well as non-patent literature. The AI should assess the relevance of prior art to new inventions and indicate where this art appears in existing filings. The USPTO believes AI will streamline and standardize patent examination processes but acknowledges the necessity for human oversight to correct potential AI errors. Despite AI’s prior usage in legal contexts where it both excelled and faltered, the Office is collecting interest from firms willing to present proposals by June 24. Selected vendors should prepare to provide their infrastructure within a secure cloud environment as the USPTO clarifies its expectation for technological delivery over monetary compensation. This initiative aims to fulfill urgent technological gaps without an outlined timeline for deployment. While AI vendors might operate on an unprecedented compensation model, the USPTO is preparing to advance its technological capabilities swiftly in the upcoming months.
